The junior sergeant from Lvov refused to obey the order and did not go to the combat zone.
The military nurse received a 102,000 hryvnia fine because she did not agree to follow the order and did not go on a business trip to the combat zone. The corresponding decision was announced by the Lychakovsky District Court of Lviv, writes Zaxid.net on March 13.
The verdict of the court, which dates back to March 8, states that the woman from Lvov works in one of the military units as an operating room nurse in the neurosurgical department. In November 2022, the junior sergeant was ordered to go to the war zone, but she was not going to go on a business trip.
During the pre-trial investigation, an agreement was concluded with the prosecutor on knowledge of guilt. The court issued a fine.
In the message of the edition it is noted that the case was considered by the judge Sergey Girich. Based on the evidence, he decided to find the nurse guilty of committing a crime under Part 4 of Art. 402 of the Criminal Code (insubordination). The submission of an appeal against the verdict is still envisaged.
As Focus reported, the Ministry of Defense is planning to draft those who evade military service into the ranks of the Armed Forces of Ukraine. The department called it “not a category of serious crimes,” because the legislative norms do not provide for obstacles to the mobilization of such persons into the army.
Earlier, Opendatabot specialists reported how many criminal proceedings were initiated against citizens who refused to perform military duty during the mobilization in 2022. During the past year, the largest number of relevant proceedings were registered during March – 282 cases. In the following months, their number showed a downward trend. Already in December 2022, 10 times fewer productions were discharged. In total, this is 1108 productions for the whole year.
