The documents say that a summons can be sent to a conscript by email or through the conscript’s electronic account. Draft evaders are proposed to be prohibited from carrying out transactions with property and to limit the right to use funds.
On the evening of December 25, the Cabinet of Ministers submitted bills to the Verkhovna Rada that provide for changes in mobilization in Ukraine and innovations regarding military registration of citizens. This was reported by the representative of the Cabinet of Ministers in the Rada Taras Melnichuk in his Telegram.
“The Cabinet of Ministers of Ukraine, as a subject of legislative initiative, has registered in the Verkhovna Rada of Ukraine: the Draft Law “On amendments to certain legislative acts of Ukraine regarding the improvement of certain issues of mobilization, military registration and military service,” said Taras Melnichuk.
As of the morning of December 26, two bills were registered on the Verkhovna Rada website:
- No. 10378 – “On amendments to certain legislative acts of Ukraine regarding the improvement of certain issues of mobilization, military registration and military service”;
- No. 10379 – “On amendments to the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine regarding increased liability for military offenses.”
Changes in issuing subpoenas
According to the bill, a summons to the TCC and SP can be sent to a citizen through the electronic account of a conscript, a person liable for military service and a reservist, or by email.
In addition, the summons can be served personally by representatives of the TCC on the premises of the military registration and enlistment office; representatives of the TCC or law enforcement officers at the place of residence or in public places; representatives of the military registration and enlistment office, employer or police at the place of work.
Changes in military rotation
According to the bill, military personnel are subject to replacement (rotation) for rest and restoration of combat effectiveness by decision of the command no later than after six months of continuous participation in hostilities. The recovery period must be at least two months. In addition, during this period, soldiers can, at their own request, move to combat units of military units to equivalent and senior positions.
Which citizens will be included in the Unified Register of Debtors?
Citizens liable for military service and reservists who did not arrive at military units on time will be included in the Unified Register of Debtors. Temporary restrictions will be applied to them, namely:
- ban on traveling abroad;
- ban on transactions with movable and immovable property;
- restrictions on the right to drive a vehicle and obtain a driver’s license;
- restriction of the right to use and dispose of funds and other valuables;
- refusal to conclude a credit agreement or loan agreement;
- suspension of receiving benefits and services from the state.
But these restrictions will be lifted after notifying the head of the TCC and the joint venture about the exclusion of a person liable for military service or a reservist from the Unified Register of Debtors.
When a citizen may not appear at the TCC
The bill states that the following are considered valid reasons for a citizen’s failure to appear on time, according to the summons, which are confirmed by relevant documents:
- an obstacle of a natural nature, illness of a citizen or other circumstances that deprived him of the opportunity to personally arrive at the specified point and time;
- death of his close relative (parents, wife (husband), child, brother, sister, grandfather, grandmother) or a close relative of his wife (husband).
Changes in conscription age and responsibility for evasion
The conscription age changes from 27 to 25 years. It also establishes restrictions on the rights of citizens who evade military registration and military service. In addition, they plan to improve the registration procedure for conscripts, military personnel and reservists.
Basic combined arms training
Conscript military service will be excluded as a type of service; as a result, all conscripts will be transferred to the reserve. Instead, basic combined arms training of up to three months will be introduced for all citizens aged 18 to 25 years. The Cabinet of Ministers also proposes to introduce basic military service at will for citizens under 25 years of age who have not completed basic combined arms training.
Vacation for those released from captivity and recruitment
Military personnel who have been released from captivity will be given the opportunity to rest and recover by providing additional leave while maintaining monetary support for a period of 90 calendar days.
In addition, a new military rank is being introduced – recruit. Also, centers for the provision of administrative services, employment centers and recruiting centers will be involved in recruiting activities for military service.
What else does the bill say?
Citizens from 18 to 60 years of age who are registered or removed from it must have a military registration document with them and present it at the request of an authorized representative of the TCC or a law enforcement officer. Military personnel who served during martial law will not be subject to mobilization for two years. They can be called up for service with their consent.
The government also proposes to exclude from the list the conclusion of the Military Military Commission on limited suitability for military service.
Now the bill must be considered in the Rada, the proposals of the Cabinet of Ministers may be changed.
Let us recall that on December 25, the chairman of the Servant of the People faction, David Arakhamia, said that the absence of a bill on mobilization gives rise to uncertainty and a large number of fakes. According to him, the military needs solutions to its problems, and society wants to hear answers to all sensitive issues.
Earlier, Defense Minister Rustem Umerov said that the military would remain in service until the end of the war and would not be able to demobilize. The Ministry of Defense will develop mechanisms thanks to which soldiers will be able to rest after two years at the front.
