According to witnesses, the quarrel was started by Michael Naccache, he, with a hand drill in his hands, insulted and even threatened another man.
Not becoming to endure such bullying, Neill Epstein answered “fuck off” and, moving away, raised his middle finger in the direction of him. On the same day, the police came to his house and arrested the man on charges of threatening to kill. However, Judge Dennis Galiatsatos observed that “fuck off” was not sufficient reason to call 911.
The case against Neill Epstein, who was accused of stalking a neighbor, was closed by the court. The judge sharply criticized the behavior of the neighbors, believing that their conflict was caused by “minor, everyday problems.”
Naccache has previously accused Epstein of assaulting his parents in March 2021.

“To be perfectly clear, pointing the finger at someone is not a crime. Tossing the notorious bird is a God-given, chartered right that belongs to every full-blooded Canadian,” the judge said.
Galiatsatos noted that showing someone the middle finger is not a criminal offence.
Naccache had previously accused Epstein of assaulting his parents in March 2021, when the judge dismissed the first charge.
