The Road Traffic Code (KOK) is known to make the use of seat belts mandatory in vehicles, and in fact the obligation does not only apply to the driver but also to the passengers, regardless of where they sit.
It is possible, therefore, that the driver’s failure to use a seat belt will result in a particularly heavy fine (350 euros) and provide for the withdrawal of the driver’s license for 10 days, however, the rest of the passengers are also punished if and as long as they follow the same tactic.
The fine provided for passengers who do not wear a seat belt is 100 euros and is assessed to the passenger himself, who automatically assumes the obligation to pay it.
The only case in which the driver is fined for not wearing seat belts is when one or more passengers are under the age of 18
Apart, of course, from the prescribed fine for each of the passengers who do not wear a seat belt, this habit can, for the obvious reasons, be fatal.
It is worth noting that in the event of a collision, a passenger may hit the front seat with force, causing serious injury to the driver or front passenger, even if the latter is wearing a seat belt.
After all, this is also the reason why the manufacturers proceeded to install sensors in all the passenger seats, forcing the use of seat belts in both the front and back row of seats, even by the side road.
